TERMS AND
CONDITIONS OF SALE
Minimum Order:
There is a $50.00 minimum for all orders. This
minimum amount does not include
freight, handling charges or taxes.
Prices:
Prices listed by JMJ Distributors, Inc.
(seller) on this web site do not include
freight, handling charges
or taxes and/or duties, and are subject to
correction/changes without notice.
Sales Tax:
Orders shipped within the state of Texas will
be subject to Texas Sales Tax unless
a valid sales tax exemption
certificate is furnished. Texas customers
should
complete the “Tax Exempt Form” found in the Customer
Information section of
the JMJ
Distributors.net website and email it
to us at
jmjdistributors@jmjdistributors.net.
Customers outside the
state of Texas are responsible for applicable taxes.
Payment
Terms:
Payment by Master Card, Visa, Discover or
American Express only and at the time
order is placed. Payment must
be in U.S. Dollars.
SHIPPING AND HANDLING POLICY
Shipping Charges:
Materials are shipped F.O.B. shipping point
with freight costs and handling fees
paid by Customer. Our standard
shipping for small orders to U.S. destinations
(excluding Alaska,
Hawaii and the Virgin Islands) is via UPS Ground or U.S.P.S.
All other orders that are too large to be handled by UPS Ground or U.S.P.S. will be
shipped by a common carrier freight line. Shipping
charges will be calculated and
added to Customer’s order.
Weights and
Dimensions:
Shipping weights and dimensions given in
seller’s catalog are as close to actual
as practicable but are not
guaranteed. No claims will be allowed because of any
discrepancy
between actual weights or dimensions of material shipped and
listed
data.
Shipping and
Packaging:
Materials will be carefully packed for shipment
and seller will not be responsible
for loss, delay or breakage after
having been received “in good order” from
transportation company.
All claims for breakage, loss, delay and damage
should be made to carriers, but
seller will render buyer all
possible assistance in securing satisfactory adjustment
of such
claims. In the absence of customer directions, goods
will be shipped by
the method and by the carrier seller believes
dependable.
Shipping
Time:
Normal shipping time is 7-10 days. However,
some items may require up to
30 days due to manufacturing time.

INFORMATION
Limited Warranty:
All products sold are warranted by seller only
to buyer for resale or for use in
business or original equipment
manufacture, against defects in workmanship
or materials under
normal use for one year after date of purchase, except
when
manufacturer’s guarantee is for a longer or shorter period, unless
otherwise stated. Any product returned to the seller, with shipping
costs
prepaid, and determined by seller to be defective in material
or workmanship
will be, as the exclusive remedy, repaired or
replaced, at seller’s option. For
further return information, see
“Return Policy.”
Warranty
Disclaimer:
No warranty or affirmation of fact,
express or implied, other than as set forth
in the Limited Warranty
statement above is made or authorized by seller. Seller
disclaims
any liability for product defect claims that are due to product
misuse,
improper product selection or misapplication, and any
descriptions does not
express or imply a warranty that the products
are merchantable or fit for a
particular purpose.
Limitation of
Liability:
Any liability for consequential and incidental
damages expressly disclaimed.
Seller liability in all events is
limited to, and shall not exceed, the purchase
price paid.
No Warranties
to Consumers:
Seller makes no warranties to those defined as
consumers in the Magnuson-Moss
Warranty-Federal Trade Commission
Improvement Act.

For information on manufacturers’ warranties,
please e-mail request to
jmjdistributors@jmjdistributors.net.
Prompt
Disposition:
Seller will make a good faith effort for prompt
correction or other adjustment
with respect to any product, which
proves to be defective within warranty period.
Before returning any
product, e-mail us at
jmjdistributors@jmjdistributors.net,
giving
date and number on original invoice, and describing defect. Title
and risk
of loss pass to buyer on delivery to the common carrier.
PRODUCT
INFORMATION
Product Suitability:
Many states and localities have codes and
regulations governing sales,
construction, installation, and/or use
of products for certain purposes, which
may vary from those in
neighboring areas. While seller attempts to assure that
its
products comply with such codes, it cannot guarantee compliance, and
cannot
be responsible for how the product is installed or used.
Before purchase and use
of a product, please review the product
application, and national and local codes
and regulations, and be
sure that the product, installation, and use will comply
with them.
CUSTOMER
SERVICE: RETURNS, CANCELLATIONS
No materials returned for credit or
cancellation of an order will be accepted
unless seller’s permission
has been obtained in each case, in advance.
Return Policy
Some items are not returnable. No returns will
be accepted without prior
seller permission and issuance of a
Material Return Authorization form (MRA).
On those items that are
accepted as returnable there will be a 35% restocking
charge and
freight must be prepaid.
Items to be returned must be in like “new
condition.” Material that arrives in
less than new condition or
damaged may not be eligible for credit.
To obtain material return authorization from
seller, use the
link
and give the reason for the requested return.
A response to
the request will be returned in two (2) business days. If
approved,
seller will forward the MRA form with an authorization number.
The MRA form must be filled out completely and a printed copy returned
with the
returned material. (Please keep a copy of the completed MRA form for your
records.)
The MRA return authorization number must
appear clearly visible and
legible on the outside of each
carton/package being returned. Material
must be returned to
JMJ Distributors, Inc within forty-five (45)
days.
All returns must be sent freight prepaid
to the address provided on the MRA form.
Shipment received without
the MRA number or not shipped prepaid will be refused.
Cancellation:
Any cancellation must be approved by seller and
may be subject to restocking and
other charges.
ADDITIONAL
TERMS
Trademarks and Copyrights:
Buyer acknowledges that it has no right, title
or interest in the trademarks or
copyrights in the products, and
buyer covenants that it will take no action to
register or otherwise
interfere with such rights.
Force Majeure:
Seller shall not be liable for any delay in or
impairment of performance resulting in
whole or in part from any
force majeure event, including but not limited to
Acts of God, labor
disruptions, shortages, inability to procure product, supplies
or
raw materials, severe weather conditions, or any other circumstances
or
cause beyond the control of the seller in the conduct of its
business.
